'Stranger Things' Creators Sued

One of the biggest talking points among those who have seen Stranger Things is how many iconic stories and filmmakers it emulates with its sci-fi story set in the '80s. A new lawsuit alleges that creators Matt and Ross Duffer did much more than pay homage to genre greats, but actually lifted the entire concept from the short film Montauk.

 

Charlie Kessler has filed the lawsuit against the Duffer Brothers that his 2012 short film, which featured the government conducting secret experiments, was the impetus for the creation of Stranger Things. The filmmaker is seeking “destruction of all materials that were allegedly ripped off from his concept.” Neither the Duffer Brothers nor Netflix have offered any comments on the matter.

 

On the surface, it might not seem like Kessler has much grounds for the lawsuit, given how many films and TV series involve narratives featuring secret government projects, but specific details that connect him to the Duffers offer a different story. Kessler purports that he showed the brothers his short at the Tribeca Film Festival in 2014, pitching them a TV series based on the concept entitled "The Montauk Project."

Netflix Announces Start Of Production On STRANGER THINGS Season 3 With New Teaser Video

Production on Stranger Things season 3 kicked off this week, and Netflix celebrated the milestone with a brief video teasing a table read that took place on Monday. The goosebumps-inducing teaser video shows just glimpses of the incredible cast - both familiar and new faces - coming together for a new adventure.

One face you’ll definitely recognize is Priah Ferguson at the end. Ferguson plays the fan-favorite character Erica Sinclair, Lucas’s headstrong little sister who had a minor, but entertaining role in season 2. Netflix announced earlier in the year that Ferguson has been upgraded to a recurring role on the show as Erica will have her own "army of friends" who will find themselves on "a wild mission to save Hawkins from a dangerous new threat."

'Stranger Things' Creators Headed to Trial for Allegedly Stealing Idea for Netflix Series

In the realm of the supernatural, a secret governmental project investigating the paranormal qualifies as remarkable. So, too, does a potential trial exploring whether Stranger Things creators Matt and Ross Duffer stole the idea for their Netflix show from a guy who allegedly pitched a project at the 2014 Tribeca Film Festival.

 

On Wednesday, a Los Angeles Superior Court denied summary judgment to the Duffer brothers in a lawsuit brought by Charlie Kessler.

 

Kessler alleges Stranger Things is based on a feature film -script titled The Montauk Project — set in the New York town in which he says is home to "various urban legends, and paranormal and conspiracy theories."

 

In January, in response to claims of breaching an implied contract, the Duffer brothers argued they didn't "manifest any intent to enter into a binding agreement" with Kessler, that they independently created Stranger Things and the ideas Kessler says he disclosed were not novel.

 

"Charlie Kessler asserts that he met the Duffers, then two young filmmakers whom Kessler never had heard of, and chatted with them for ten to fifteen minutes," wrote the defendants' attorney. "That casual conversation — during which the Duffers supposedly said that they all 'should work together' and asked 'what [Kessler] was working on' — is the sole basis for the alleged implied contract at issue in this lawsuit and for Kessler's meritless theory that the Duffers used his ideas to create Stranger Things."

 

In denying summary judgment Wednesday, Los Angeles Superior Judge Michael Stern says there is no "novel" requirement under either New York or California law.

Apparently none of them ever saw the X-Files or 500 movies/TV shows before that dealing with these topics?

Almost all of the characters get denser storylines to play out. The action is exponentially bigger than the previous seasons. It’s funny, gross, sweet, and fun, and by the end, the whole thing gets so massive and exciting, you’re likely not to remember a few of the hiccups along the way.

 

Stranger Things 3 may spin its wheels to get where it’s going, but it lights a fire once it gets there. The season is flawed but solid, and we hope it’s not another two years before we see part four. If it is, who knows how big the kids are going to be, both on screen and off. And we mean that literally. They are growing very, very fast. Will is taller than Joyce this year!

 

Okay, so that’s one spoiler. We’ll discuss many, many more after July 4 when Stranger Things 3 debuts on Netflix.

Started watching Season 1 two weeks ago and finished Season 2 over the weekend just in time for Season 3 to start this week. 

What a great show!

Me too!  Not yet done re-watching season 2, about 4 more episodes left to go.  A masterpiece!

Disappointed in season 3 so far. Loved 1 & 2. Trying too hard with nostalgia and not digging the writing so far. It may have jumped the shark. Turned it off midway through episode 2. Will revisit at some point and hope it turns around
