i do have a question though. I had a friend who lost his comic book store around 1992. I got 52  boxes of comics, lost some in a divorce but have 33 long boxes that I stored ever since. Being busy I never got to look at them. All I do is maintain them. As I've been getting them graded they are mostly 9.2 and higher. The little bit of silver is lower but the rest has been better. What would be a good strategy for them?

He specifically says the book is not restored and thinks the book is 8.5/9.0.  CGC is very tight right now so I can see why he thinks its a 8.5 but the restoration is a deal breaker (especially with that much).  I'd contact him right away and let him know the issue and see what he says.

If eBay doesn't work out you can always go through PayPal or their credit services to process a fraudulent charge as this is definitely fraud.  The bottom line is the seller sold you an item that turned out to be the complete opposite of the described item.  You're lucky they actually mention the restoration because this is the statement that will get you your refund.  And the $3k estimate is right on so if you paid $18k for the book you're substantially in the red.

There are a ton of board dealers in southern CA so I'd probably ask one over to give you a quote and in the mean time check to see how many key books you have in the boxes.  Keys will decide 80-90% of your offer price.

If you enjoy collecting then I would have someone come out and go through them.  Pick out all the books worth having graded then break them out by value.  Out of 33 long boxes I'm pretty sure you'll have numerous long boxes of books you may not want to hold onto.  Maybe find a dealer who doesn't mind the time spent with $`1 bins.

I've sent a bunch of Asm, nm and uncanny xmen, sold them off. The last batch had a secret wars 8 9.2, uncanny x-men 118 to 210 (picked out by eye appeal) and grades were 9.2-9.4 20 books total. I was going to list on eBay but this whole event makes me wonder

That's the problem with sending in a bunch of books to get graded without testing the water a bit.  Your Secret Wars 8 is a $60 - $70 book in CGC 9.2 and would have been a $50 - $60 book raw on E-Bay as a NM-/NM.  When you subtract grading fees (and especially pressing fees if you go that route) you can a lot of time do better just selling the books raw on E-Bay.  The CGC 9.2 X-Men 118 - 210 will a lot of time be worth a bit more then the grading cost so you have to be sure a book is worth the time to get graded.

And when you factor all the time and effort it does make sense to sell to a dealer (unless you have a ton of time on your hands) and then you have access to the cash for other things.

It's a bit of a learning curve at first figuring out how books will grade then calculating cost and sale price. Especially with copper age and moderns where 9.8s are almost mandatory

The seller is offering me 2 options, 1, I return the comic and recieve 75% back and he keeps 25% as a restocking fee or 2. I keep the comic and he refunds 30%. Both put me at a disadvantage. Do I need to work with him on one of these option or can eBay step in?

I would go with Option 3, after 3 days escalate it with ebay and let them decide.

It's funny you said that because in the email he said I should get a 2nd opinion because restoration is a grey area. It seemed he was trying to say the no restoration comment was just there because he had a local shop check it out. I told him the reason I contacted and did business with him is because his claim of no restoration. And the moment I received it I sent it out and paid an expert Cgc to determine if his claim was true because I am not a specialist. I get the feeling he is reaching because he knows he is wrong but not willing to do the right thing. After all his comic is now in better condition then when received. Cleaned, pressed, Graded and encapsulated. I can't ask for that to be refunded as well?
