Theo just responded and here is his response back to me when I told him his art is 100% NOT DRAWN BY JOHN ROMITA SR............

"Mike your entitled to your opinion!

But in my opinion it’s a great Spiderman and to me it looks like it’s done by Romita which i I am entitled to my “opinion!

That’s why we live in America freedom of speech you know!

I appreciate your opinion it’s just different then mine!"

He just raised the price from 59k to 69K after our email exchange! :)

This entire listing is an insult to JR Sr.  I have asked him to change the item description immediately or be reported for fraud.

And it's up to $59k on the strength of the false claim to be Romita! How can this be reported to eBay, if the seller is unresponsive? I looked at the "report" options but couldn't find one for misrepresentation/false attribution of origin. Maybe eBay specifically doesn't want to know about that sort of thing so they can't be held liable. Caveat Emptor!

I just got a response from him. I share it with you all :

"My add title says spectacular Spidermsn the cover and splash for 259 was done by a Romita the rest of the book had other artists go to This is a known fact"

Well...

Between this response and the new description...

"Original Art Spectular Spiderman #259 Romita Spiderman Splash. Ross did only the Green Goblin upper corner of splash This is the best image of Spiderman he has ever done Romita man sold and advertised sketch of a earlier issue for $200,000 this image is better Shipped with USPS Priority Mail."

... it leaves me speechless...

Yeah, like @romitaman said, it's now got a $69K starting bid! But no, no one has bid on it and I doubt anyone will. The description is even funnier now:

"Spiderman Splash art for issue # 259 in “my opinion” I definitely attributed it to be done by Romita sr ! More ! Mike Burkey disagrees with my opinion and doesn’t think the splash is by Romita but I 100% disagree with that! If you are familiar with Classic Romita Spiderman art You can judge for your self! The Original cover Art for Spectular Spiderman #259 according to Marvel Data base was Romita! According to the internet Romita did the cover to this issue and possibly the splash ! Interesting enough this splash was supposedly originally planned to be the Spiderman 259 Cover ! In my opinion the splash is much better then final 259 Cover! just judge for your self ! Romita man sold and advertised sketch of a earlier issue for $200,000 this !I like this one better Shipped with USPS Priority Mail."

To be fair, he doesn't appear to have any ill intentions. He just believes what he believes, and of course is selling this piece based on that belief. I wonder where he got this and how much he paid for it. Hopefully he wasn't swindled.

I wondered about that. Who would take the report? Not eBay, as best I can tell. Does the FTC or FBI care about individual cases of eBay items with incorrect information?

Well, he seems to change title and description according of what we tell him... In the first version version of the ad, before I contacted him, there wasn't even the mention "Spectacular" in the title, only "Spider-Man"...

Now he's changed it so that the main image for his offering is a digital mock-up making the Spidey splash into a fake cover image! You have to scroll through the images to find the one that represents the actual page.

We can take solace that the rarified group of buyers who would cough up $69,000k for a page are also the people who are going to want a clearer Romita provenance than the seller's opinion.

Right? Or are there some gullible and uninformed buyers in that price stratosphere?

I can't speak for the whales (I ain't no Aquaman) but if this doesn't ring all the warning bells in the universe you deserve to get taken:

"As a pioneer of the comic book movement in the 60s and the 70s an as a long time comic art book dealer and art minor in collage I comsider my self the best person to evaluate who the artist was for this Spiderman splash! Unfortunately like the fake news there are a few big comic dealers who are giving out misinformation about the artist! "

But his minor is in collages. Collages!!!exclamation point

I comsider his kredentials to be impeckable!

Do you think he'll honor that sell price for Detective Comics # 27 if I show him this ad? I'd give him positive ebay feedback!

Also, if he REALLY wanted to settle this Spider-Man debacle, couldn't he just reach out to Luke or the Romitas and ask?

*Edit: Guys, he's got a Detective Comics # 27 (1 page only) listed on ebay and...it's hilarious! He put pictures of some dialogue he had with someone who contacted him about errors in that listing. It's a good read. https://www.ebay.com/itm/Detective-Comics-27-1st-Origin-First-Appearance-Of-Batman-Worlds-M-Valuable/333804318056

I don't think either of these items will flip. Nor will the Heidi Doody doll that was once "next to actual Howdy Doody puppets."

I've seen this Theo Holstein ad before and have always wondered about it.  Are we sure this isn't all a bunch of 70s-era gay lingo being used that just got confused for comic stuff over time:

Silver Streak?   Daring Mystery?   Action?   Human Torch?   Sub-Mariner?   All Winners?   Young Allies?   More Fun?   Tough Kid Squad?   Boy Commandos?

There are people who will know far better than I but wouldn't the original page from this issue of Spectacular Spider-Man also have the lettering on the page? It was released in 1998 which I always believed was still prior to digital lettering.

The image is definitely from issue 259.

I thought that by 1998, all Marvel comics had switched to digital lettering, but maybe I'm wrong... In comparision, DC still put lettering on pages in 1998 ; they made the switch later.

Anyway, there are others pages on CAF from that issue which don't have lettering too :

Yea, I'm certainly no expert haha. I know I have a few GL pages from around that time and I want to say into early/mid 2000s that still have their lettering on the physical page so I was assuming it was similar for Marvel but there will definitely be people who know better than me

Right. From my own experience, that's what sellers pissed about usually do.
