I've had similar things happen listing Tijuana Bibles. Just make a new listing and change the title wording a bit. Eventually it will stick. Ebay has prohibitions against listing adult comics in the regular comics sections, but they enforce it only sporadically. So instead of trying to get everyone else's listings removed, just make another attempt.

Whomever you spoke with on the phone is probably not authorized to remove listings in bulk and would need to probably spend time on each listing and not on the phone.  Moreover, yours was probably removed due to a specific complaint from a user.  Your complaining about all the listings was probably considered just retaliatory and not followed up on.

I don't work there, but from dealing with them since the 90's (God I'm OLD) I see this as their M.O.  To answer your question about suing, it would be an expensive uphill battle on your part and probably get you nowhere since it's their platform and can do most anything they want so long as it's legal.  And let's be honest, the only pain you received was to your ego.

My ego received no pain. I melted the ear off a supervisor a while ago. The retaliatory argument is not logical in this case. You’re right about the person from EBay not being able to act. That is why I reported each person individually afterwards by using the report function for each listing. I received a confirmation “Thank you” for each report. Reporting does not allow for extra comments. There are three drop downs to select from.

Yes I am enjoying the fight against a huge company. We will see if the listings are removed.

I listed a CGC Funnybook and a CGC Cherry Poptart #2 on Ebay a few days ago. 

After 2 days, I got an e-mail that they were removed and needed to be listed in the "Adults only" section.

I called and asked them about the other 50+ Cherry listings in non adult categories.

The lady on the phone said she saw what I was talking about and would remove them.

24 hours later I called and told them the 52 listings (dating back to August 2017) had not been removed as promised.

I asked them why I was being discriminated against. The Ebay rep had no good answer, so I asked to talk to a supervisor.

I was put on hold for a few minutes, then was told a supervisor would have to call me back "shortly."

It has been over an hour and no one has called me back.

Am I fighting a brick wall? How can Ebay legally get away with this?

 

Did you cover the parts on the cover that would have required those books to be in the Adult section?

Well I can't speak to the particular matter with eBay as I can only go by what you shared, but issue #2 does feature a cover far more sexually exploitative (i.e. s&m/bondage) in nature than practically any other cover in the run. I'd understand if this was 52 other examples of #2, but I can kind of see why. For what it's worth, I've sold numerous copies of issue #1 with no issues.

Perfectly logical to block slabbed comics like Funnybook and allow that.

I really am stopping after this. I think.

Screw a lawsuit. Write a letter with 50 search words that will pull up very bad stuff. Send it to all online news agencies (Daily Mail anyone?) and see if they would be interested in writing a story with a heading like “Don’t let your children search EBay!”

Then throw in some of same on social media.

have you tried listing them in the adult only section? Stuff sells there as well. Or try selling it these boards

Letting this bother you is a waste of time for all parties. Better to just adapt your listing until they stop removing it.

I have had numerous items removed for these types of reasons-- which sucks sometimes because the listing is completely gone-- and you can't simply relist it and correct what they had issues with-- be that incorrect category or whatever. Words like ADULT and NUDE set off triggers== not that this is what happened in your case, but it can.

Sometimes I think competing sellers with the same item are the ones who draw attention to this so that they effectively eliminate the competition. If you start doing the same to others, you are making the problem worse. And eBay doesn't care either way.

PS-- Suing Ebay is probably the craziest thing I've ever heard and calling this discrimination is an inaccurate use of the term.

Who knows how ebay decides what's kosher. My wife sells antiques on ebay, and has gotten stuff canceled for having "bone" or "shell" in the listing because she didn't specify the species, and some are illegal to trade in, and you can forget listing anything as "ivory".

I sold some playing cards that were pornographic in nature (leftovers from a bachelor party I hosted and someone brought/left) -- but did so on the adult only side. But had no problem selling sealed Hooters girl playing cards sets on the regular ebay site.
