Is there a tear at the bottom of the bottom staple in the spine or is that just the roof of the building? If so, i will go 3.5 up to a 4.0, but i am still new at this myself.

I added a few more pictures but I don't think it helps much the lighting is off. Also yes there is a tear at the bottom staple.

The front looks really nice in the first pic. The back cover has the tear, plus what looks like a heavy impression or crease and minor stains. I'd guess 5.0 or so. Nice one!
