Yah, we all agree that in any venue, its gonna be a tough case for the plaintiffs to make, and in the event they make it effectively, a really tough case to collect damages on. I think the plaintiffs are hoping for a couple bucks for a settlement but more realistically some nice publicity. It doesn't sound like Mr. Waid is too worried about it, but it does take money to fight. As per usual, the lawyers are the real winners here. Plaintiff is represented by a real looking austin lawyer. If on contingency, this may not be worth his time. Otoh, if he got a $100k retainer out of that $400k they raised he may not give a hoot whether the case is a loser.
