I think yes, you could get a green label (qualified) 9.0 IF its VERY clear is was produced without the staple.

I'd say for more in depth and accurate analysis, contact CGC directly and ask them how they think it will be handled and what your options are.

 

On a side note, hopefully this question was more out of curiosity than anything else.

Even if you hit a blue label 9.0 (which won't happen), you likely would not recover the cost of grading the comic, not to mention its not really that hard to get a copy of the comic WITH all the staples, especially in 9.0 (I get that 9.6 and 9.8 are worth much more).  Of course, if there's sentimental value and/or money is no object to you, please grade away!

Sorry to disagree but I think you can a blue label for a legitimate missing staple. I don't even think they downgrade for it.

You may have been thinking about an extra staple, which is viewed differently. Technically, the extra staple has introduced new holes. If removed, it usually gets a Green Label or a hammered Blue Label.
