Popped top staple or Not

Just bought a comic on eBay and when it arrived the top staple was popped or pulled through.

Now I asked for a partial refund because I’m working on a Atomic Knights run. 

The dealer asked for photos of the damage I sent him a photo. Not good enough he said he wants better pictures so I sent him a couple of more,still not good enough. After sending him 4 different groups of photos of the damage he still doesn’t believe me and can’t see the damage.

So here’s the pictures. Give me some feedback does it look detached or not at the top staple

I mean you can clearly see the edge of the paper that was once under staple-this should not be possible without X Ray vision with an MRI ability to see slices of object
