This is the end result of an unrelated third party injecting themselves into the situation.

CGC should have said, from Day 1, that they are an uninvolved, unrelated third party which has nothing whatsoever to do with what happens between a creator and a member of the public.

If they had done that, we would never, ever be having these kinds of conversations. It's no creator's business what someone does with THEIR PROPERTY once they walk away. Sign, don't sign, that's all a creator has the moral and legal right to control.

Allowing themselves to be dictated to by creators opened the door for those creators to abuse a process they know virtually nothing about.

It was a bad, bad move.

So are you saying what they're doing is illegal?

I'm not sure you're reading it the right way.

BUT I think RMA is saying that the ONLY thing any creator (in this case Liefeld) can control is  whether or not he signs the comic.  After that, he doesn't have any moral or legal control over what happens with the comic (to the extent there is no other pre-arranged agreement between the owner and Liefeld, or Liefeld and CGC for this specific example).

BUT he CAN exert his influence (both market and otherwise) to achieve non-legally enforceable goals like not having the Deadpool label on CGC SS comics signed by him.  While a court wouldn't stop CGC from doing it, Liefeld could just stop signing CGC SS altogether, which would hurt both the reputation and pocketbook of CGC.

So I think RMA's point is there is no LEGAL imperative imposed on CGC by Liefeld's refusal to sign with the Deadpool label.  The moral imperative is also not imposed, but that would be so relative and nebulous its barely worth discussing.  There is likely a business/marketing imperative imposed, which is likely to be equally or more effective.

Don't understand. CGC is asking him to sign the actual labels before they use them? How can he sign comics that have the label when the only way they can have the label is is they are already slabbed?

If McFarlane was paid only $50 a book to sign in his last signing with CGC he netted a cool 650k. Even if he was only getting $30, that's 390k. All for a couple days work and having to stay in a hotel.

Artists are DUMB to not collaborate like this.

@Kevlar How much did the actors most likely take away from that Aliens commission a few years ago?

He only said he won’t sign the label, didn’t say anything about not signing books...

True. He also didn't say he wouldn't sign the ASM, Venom or Wolverine labels. Who wouldn't want him to sign their ASM #361?    That's a whole new untapped market!

Different actors have different guarantees...some have no guarantee at all. Sigourney obviously took in more than Carrie Henn
