From that picture, I would say no, it's not a 9.8. That's pretty heavy spine stress that I imagine it would be below a 9.0 in that shape. 

 

There is the possibility cgc determined that was a production issue.  I looked at a few on eBay to see if it was common and I didn't see any others like that (I only looked at 2 or 3 in fairness)

Some modern books have some serious spine issues in production. I remember some DC books a around the new 52 era being especially bad. If an issue is deemed to be a production error by those grading, then a 9 8 is obtainable. Like how amazing spider-man 361 could be 9.8 and still have a really obvious rip on the cover.

Same thing happened here. Best thing to do now for you would be to look at other examples of that book being sold.
