Well, I will say this.

 

A very very good customer of mine told me to check this out. Said I was being "flamed"

 

I thought it only fair to defend myself best I can.

 

Its a very hard business. We are in the business of helping others or those who do not know anything about comics sell their comics to people like you.

 

We run another site... www.ComicsForCash.com and invite those who want to sell their comics to it. We generally have the comics in hand, but there comes time when we can not assure we have them before we represent them.

 

We operate on 100% honesty, and have had chances to get 1000 Silver age DC's for $1 each, but sell them on eBay instead for them, and yield THOUSANDS of dollars more.

 

Sterling, I am very sorry if you waited for this auction. I am so angered at my client, and hope that they will deliver the books this week so we can put them back up. Needless to say my fee will be more, but I am very sorry for anything this might of put you through.

 

I buy on eBay as well and understand its a crapshoot sometimes. But I like to be a sure thing.

Just to let everyone know, I am a consignment seller on eBay.

 

The owner of these comics failed to deliver as promised by contractual obligation by 12 noon today these comics. Rather then having them end and maybe or maybe not get the comics, I decided it was better to just end the auction.

 

You will be happy to know that my contract's for consigning comics have been amended to make sure nothing like this happens again. All comics that I sell will have to be in my possession before listed.

 

I apologize to anyone who was watching this auction. These comics will most likely be auctioned off again in the weeks to come. That is, if the owner meets the obligations set for beforehand.

 

As for why the auctions were not ended quickly. I was spending the day with my father, and only made in home in time to end the rest.

 

Again, my apologies.

So why did you wait so freaking long to end them, with some around a minute or two left?

 

Plus, you're either lying here, or lying in an email where you told me:

 

"Someone bought them inhouse. What was I supposed to do?"

 

You also stated they paid $4 per issue in the next email, so which lie do you want us to believe?

Okay, I assumed that the evidence was pretty cut 'n dried for this case of a seller contravening EBay regulations and ending a ton of auctions to avoid fees/low prices, but it appears that a single fantasy-filled comment by the seller is enough to convince the weak-minded.

 

Now let's take a look at the evidence, and you can decide for yourself:

 

1) The seller states" The owner of these comics failed to deliver as promised by contractual obligation by 12 noon"

 

2) Almost 8 FULL HOURS later, the FIRST Captain America 120-129 Auction ends at a measly $16.50.

 

Ended: Jun-20-04 19:23:50 PDT

 

3) Soon after, the subsequent Captain America 130-139 10-issue lot is ended, again almost 8 hours after the seller *supposedly* did not receive the books:

 

Start time: Jun-10-04 19:26:12 PDT

Ended: Jun-20-04 19:24:25 PDT

 

So do the math; 1 minute and change left on the timer, and this continued on down the line through the Captain America 140-190 lot listings, which were all a few minutes from ending.

 

4) I inquired as to why the seller ended the auctions, and got the following replies:

 

"Someone bought them inhouse. What was I supposed to do?"

 

"Besides, your snipes were probably for like $2 an issue, I got $4 in house"

 

Now I really can't imagine how anyone could come up with anything but the logical conclusion regarding these auctions ending.

 

For example, why if the seller did not have the books by 12 noon, did he not end the first Captain America 120-129 lot in time, when he had almost 8 FULL HOURS to do so?

 

Why did the seller suddenly find the time to end the Captain America 130-139 auction with 1 minute left, when he had almost 8 FULL HOURS to end it previously?

 

Why are his stories on here, and in the emails he sent me, totally different as to the cause of the ended auctions?

 

He's got to be lying in at least one of the scenarios, and doesn't even seem to be able to keep one fantasy straight from another.

JC, at the risk of incurring your wrath, what if the seller got home from his dad's around 19:24 after the first auction already closed and then began shutting down the other auctions. were the remaining half dozen separated by 5-10 minutes each (in which case his story seems weak) or just a matter of 20-30 seconds each, which would explain why each one closed so close the the original shutdown time. i couldn't find the other auctions or i wouldn't be supposing here.

 

in any event - i'm generally with you 100% on this issue - i HATE it when someone is dissatisfied with the way things are going and decides to pull the auction before the snipers can start firing away. they should just have a reserve so as to be guaranteed an acceptable level of return. 893scratchchin-thumb.gif

JC, it was late, and I'm not privy to the conversations you had with the seller. I don't appreciate the "weak minded" comment, but that's ok. All I'm saying is that the seller at least tried to make some amends, albeit with some advertising.

 

I personally think no matter how much mud you bring up against this guy, at least he is acting civil about it in an online forum. Hint: style and approach does count-calling folks "dickwads" isn't my idea of professional.

 

You have a right to be angry and frustrated, and your points are valid. But whatchagoinna do?

I personally see it as an attempt at covering his . I find it very very unlikely that he waited until the end to cancel the auctions because the comics nevered showed up. He sure enough was able to have pictures of the comics..... 893scratchchin-thumb.gif

JC, at the risk of incurring your wrath, what if the seller got home from his dad's around 19:24 after the first auction already closed and then began shutting down the other auctions.

 

I think you'd have to pretty simple to buy an explanation like that.

 

Captain America 120-129: Ended: Jun-20-04 19:23:50 PDT (Sold at $16.50)

Captain America 130-139: Ended: Jun-20-04 19:24:25 PDT (Closed by Seller)

 

35 SECONDS between the first lot ending at a low price, and the second lot being closed. Do you honestly believe anything like that could ever happen the way the seller describes it?

 

His other auctions ending times differed by 16 seconds, due to navigating and clicking through the EBay End Auction pages, and finally closing each lot, so the 35 seconds between one ending and the other closing is actually only 19 SECONDS in real time.

 

19 measly seconds...... think about the logistics of that one for a minute.

 

Since the first Captain America lot was allowed to end, and at a low market price, and then immediately after, the seller closed all the other auctions, it would take a coincidence of galactic proportions to believe his latest fairy tale.

 

And this is even totally ignoring his email to me stating that he "sold the books inhouse".

 

Do the math.

wow that was fast - thanks..........so the auctions only ended about 16 seconds apart on average. how long does it take to cancel an auction?? can you do more than one at once?? doubt it?? just saying that there is some logic (IMO) to when the auctions ended relative to their respective original shut-down times. NOT saying this is what happened, but it's what i'd be telling JC and the board happened devil.gif

Excellent point, and I can't believe I missed that. He was able to get photos of the books, grade some of the lots NM/M, and then suddenly doesn't have access to the books 1 minute before Captain America 130-139 ends?

 

And as for his reply, he knows he's toast, so the best angle to take is to produce a lame fairy tale reason, post TONS of ADVERTISING LINKS and hope that it has the desired effect on the weak-minded.

 

On here, that's not such a bad risk. 27_laughing.gif

And you wonder why people continue to bid on KEY COMIC lots online, with all the "evidence to the contrary". People like you laugh at their stupidity, but take it hook, line & sinker from other sellers.

JC, I agree with Sterling on this point. You shouldn't resort to calling people "weak-minded", we all know what you think of people who don't think a crash is coming. However, you seemingly left out the "sold in-house" comment by the seller's e-mail in your initial posts. The seller came on here and provided a plausible explanation, unfortunately it doesn't play out like you say.

 

He was 100% wrong in listing items that supposedly he didn't have. I commend him for coming on the boards and offering a discount on merchandise form his site.

 

You, JC, are 100% wrong in calling others "weak-minded" without providing all of the information. Totally uncalled for, especially in asking for our help in reporting the seller. 893naughty-thumb.gif
