BREAKING Jury Decides For San Diego Comic-Con In Trademark Suit

Looks like internal e-mails sent between the SLCC organizers may have been a big part of it.  SDCC was asking for $20mil in damages, but only received $20K.  Let the re-branding commence.

I don't get it either.  It certainly changes the landscape for any show using 'comic con' or any variation of it now.  The thing that likely worked against the SLCC organizers was a series of internal e-mails that popped up during discovery.  That and (I believe) the trial was held in San Diego.  The verdict is the verdict, and we all know it doesn't mean  the jury called it right.

Rose City Comic Con and a few others have preempted any legal problems by getting licenses to use the term comic con in their event names prior to the verdict.  All other shows not seeking permission will likely take 'comic' out of the event name and just go with 'con', or wait for a cease and desist letter.  It'll likely be the big shows getting those notices first.  This , is going to cost some shows a good amount of money and hassle with buying new URLs, graphics, banners, printing, business registrations, and the like.

In 1996 SDCC attempted to register (R in a circle) the comic-con mark.  As CEO of the Chicago Comicon, I protested their registration since we would have had to ultimately purchase a license from SDCC or change our name.  The Chicago Comicon owned no assets but its name and we would have had to pay SDCC for the right to use our own name!  We used TM on our logo to protect our own brand, but never attempted to register the mark since we believed it was in common usage across the country.  This was big news back then, and we used the same David and Goliath tactic.  We prevailed and the Trademark Office rejected their registration.  A year later we sold the show to Wizard and they dumped Chicago Comicon in favor of Wizard World.  Apparently that gave SDCC a green light to try again and they were awarded the mark.  After the fall of Wizard World, the owners decided to become Chicago Comic Con since everyone was familiar with Comic Con but not so much Wizard World.  It's interesting to see what will happen.

a few thoughts on this:

1. thanks SLCC for messing with with SDCC and ruining it for all other comicons

2. If you're planning on doing something that could be misconstrued as wrong/illegal that you wouldn't want anyone else knowing don't disuss it over any recordable or interceptable media like email, text, phones, posts, letters, etc.

3. If and when there are no more comic vendors at SDCC the irony of the show will be complete.

That could happen some day within a decade or less if the booth tables keeps go up. Who knows? Chuck already abandoned from there after the fasico this year. 

Whatever way it goes, I could care any less. (shrug)
