I am not a fan of over spray and scuff but I could see a cgc 9.8

Whatever you think. If its for your collection than someone else's grade is irrelevant. For my personal collection I can care less what cgc calls the book. My grade is the only one that matters.

It is for my personal collection, but since there are only three issues featuring on of my favourite characters, Arsenal, and I own the other two in 9.8 grade already I though it a perfect time to strive for the specific grade for my fun set: https://comics.www.collectors-society.com/WCM/ComicCustomSetView.aspx?s=29180

I was also thinking the scuff could be removed with a little dry cleaning, so hence why I'm considering it.

9.4-9.6

I know CGC says production flaws don't hurt a book but I think they will look at that back cover with that slight miscut along the bottom plus the light scuff along the back spine and hit it with a 9.6. Hope I am wrong but mentally, I would prepare for that if you do sub it.
